1. Acceptance of Terms

Welcome to CallScout Pro. These Terms of Service ("Terms") govern your access to and use of our smart caller ID system, including our website, mobile application, and related services (collectively, the "Service"). By creating an account or using the Service, you agree to be bound by these Terms.

If you do not agree to these Terms, you may not access or use the Service. We reserve the right to update these Terms at any time, and your continued use of the Service constitutes acceptance of any changes.

2. Description of Service

CallScout Pro provides a smart caller ID system that allows businesses to:

  • Identify incoming callers using customer database matching
  • Display customer information, order history, and notes in real-time
  • Manage customer records, orders, and staff
  • Customize branding and business settings
  • Handle multi-line phone systems

The Service consists of a web-based dashboard and an Android mobile application that detects incoming calls and sends data to the dashboard.

3. Eligibility

You must be at least 18 years old and capable of forming a binding contract to use the Service. By using CallScout Pro, you represent and warrant that you meet these eligibility requirements.

If you are using the Service on behalf of a business or organization, you represent that you have the authority to bind that entity to these Terms.

4. Account Registration and Security

4.1 Account Creation

To use the Service, you must create an account by providing accurate, complete, and current information, including your name, email address, business name, and payment details.

4.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to:

  • Use a strong, unique password
  • Not share your account credentials with others
  • Notify us immediately of any unauthorized access or security breach
  • Ensure that your account information remains accurate and up-to-date

4.3 Account Termination

We reserve the right to suspend or terminate your account if you violate these Terms or engage in fraudulent, abusive, or illegal activity.

5. Subscription and Payments

5.1 Subscription Plans

CallScout Pro offers multiple subscription plans (Starter, Professional, Enterprise) with different features and pricing. All plans include a 7-day free trial period.

5.2 Free Trial

New users are eligible for a 7-day free trial. No credit card is required to start the trial. If you do not subscribe to a paid plan before the trial ends, your account will be suspended, and access to the Service will be restricted.

5.3 Payment Terms

Subscription fees are billed monthly in advance. You agree to pay all fees associated with your chosen plan. Accepted payment methods include:

  • Bank transfer (Pakistan) with payment proof upload
  • JazzCash/EasyPaisa (coming soon)
  • Credit/debit card via Stripe (international customers)

5.4 Billing and Renewals

Your subscription will automatically renew at the end of each billing cycle unless you cancel before the renewal date. You authorize us to charge your payment method for recurring subscription fees.

5.5 Refunds

All subscription fees are non-refundable except as required by law. If you cancel your subscription, you will retain access to the Service until the end of the current billing period.

5.6 Price Changes

We reserve the right to change our pricing at any time. We will provide at least 30 days' notice of any price increases. If you do not agree to the new pricing, you may cancel your subscription.

6. Acceptable Use Policy

You agree to use the Service only for lawful purposes and in accordance with these Terms. You may not:

  • Use the Service to violate any local, national, or international law
  • Upload, store, or transmit malicious code, viruses, or harmful software
  • Attempt to gain unauthorized access to our systems or other users' accounts
  • Use the Service to harass, abuse, or harm others
  • Scrape, copy, or reverse-engineer any part of the Service
  • Resell or redistribute the Service without our written permission
  • Store or transmit content that infringes on intellectual property rights
  • Use automated systems (bots, scrapers) to access the Service

7. Data Ownership and Privacy

7.1 Your Data

You retain all ownership rights to the customer data, order records, and other content you upload to the Service ("Your Data"). You grant us a limited license to use, store, and process Your Data solely for the purpose of providing the Service.

7.2 Data Responsibility

You are solely responsible for:

  • The accuracy and legality of Your Data
  • Obtaining necessary consents from your customers to store and process their data
  • Complying with applicable data protection laws (e.g., GDPR, CCPA)
  • Maintaining backups of Your Data

7.3 Privacy

Our use of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

8. Service Availability and Support

8.1 Uptime

We strive to maintain 99% uptime for the Service, but we do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or unforeseen technical issues.

8.2 Support

We provide email and WhatsApp support during business hours (Monday-Saturday, 9:00 AM - 6:00 PM PKT). Enterprise plan customers receive priority support.

8.3 Modifications to the Service

We reserve the right to modify, suspend, or discontinue any part of the Service at any time with or without notice. We will not be liable for any such modifications, suspensions, or discontinuations.

9. Intellectual Property

9.1 Our IP

The Service, including all software, designs, text, graphics, logos, and trademarks, is owned by CallScout Pro and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on our IP without our written permission.

9.2 Feedback

If you provide us with feedback, suggestions, or ideas about the Service, you grant us a perpetual, worldwide, royalty-free license to use, modify, and incorporate such feedback into our Service without any obligation to you.

10. Disclaimers and Limitations of Liability

10.1 No Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

10.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CALLSCOUT PRO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITIES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify, defend, and hold harmless CallScout Pro and its officers, directors, employees, and agents from any claims, losses, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any third-party rights, including intellectual property or privacy rights
  • Your Data or any content you upload to the Service

12. Termination

12.1 Termination by You

You may cancel your subscription at any time from your account dashboard. Upon cancellation, you will retain access to the Service until the end of the current billing period.

12.2 Termination by Us

We may suspend or terminate your account immediately if you:

  • Violate these Terms
  • Fail to pay subscription fees
  • Engage in fraudulent, abusive, or illegal activity
  • Use the Service in a way that harms our reputation or infrastructure

12.3 Effect of Termination

Upon termination, your access to the Service will be immediately revoked. We will retain Your Data for 90 days to allow for reactivation, after which it will be permanently deleted. You may request an export of Your Data before termination.

13. Governing Law and Dispute Resolution

13.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of Pakistan, without regard to its conflict of law principles.

13.2 Dispute Resolution

Any disputes arising out of or related to these Terms or the Service shall be resolved through good faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration in Faisalabad, Pakistan, or through the courts of Pakistan.

14. General Provisions

14.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and CallScout Pro regarding the Service and supersede all prior agreements.

14.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

14.3 Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

14.4 Assignment

You may not assign or transfer these Terms or your account without our prior written consent. We may assign these Terms to any successor or affiliate without your consent.

15. Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by:

  • Posting the updated Terms on our website with a new "Last Updated" date
  • Sending you an email notification

Your continued use of the Service after any changes constitutes your acceptance of the updated Terms. If you do not agree to the changes, you must cancel your account.
